Searches for Forward Financing lawsuit usually surface private commercial collection and contract disputes involving Forward Financing LLC. A Boston-based revenue-based financing / future-receipts funder, not a Federal Trade Commission or New York Attorney General industry-wide enforcement action like the public Yellowstone Capital lawsuit track. This page summarizes what identifiable public records establish, and what a single order does not prove about your file.
Editorial update: 2026-10-30 · Desk research of published court opinions, public petitions, and company materials only. Not legal advice, not affiliated with Forward Financing LLC.

Quick answer
| Question | What the public record supports on this page |
|---|---|
| Who is the litigating entity? | Filings commonly name Forward Financing LLC (Delaware LLC; principal place of business described in petitions as Boston, Massachusetts) |
| Is there an FTC / NY AG “Forward Financing refund” program? | No equivalent public FTC redress or NY AG debt-cancellation program for Forward Financing is described in the sources checked for this page |
| How do many disputes leave the private docket? | Company agreements frequently include AAA Commercial Arbitration clauses; publicly visible NY filings are often petitions to confirm arbitration awards under CPLR Article 75 |
| Notable published federal opinion | Forward Fin. LLC v. Moss Supermarket LLC, 303 F. Supp. 3d 209 (D. Mass. Mar. 29, 2018): court denied a default-judgment motion without prejudice for defective service and insufficient personal-jurisdiction allegations |
| Does that denial wipe Forward balances? | No. It addresses service and jurisdiction showings in that case, not a finding that every Forward Financing obligation is invalid |

Why Forward Financing lawsuit results look different from Yellowstone
Yellowstone Capital appears in agency enforcement materials (FTC settlement/refunds; later NY AG settlement with debt cancellation for covered Yellowstone entities). Forward Financing results more often look like:
- Funder-as-plaintiff federal collection suits (especially earlier Massachusetts dockets) against a merchant and guarantor for alleged breach of a future-receipts / revenue-based financing agreement
- Private AAA arbitration, followed in some files by New York Supreme Court confirmation petitions and judgments on the award
- Occasional merchant-side suits alleging a product was a usurious loan rather than a receivables purchase. Allegations or pleadings unless and until a court decides the merits
- Procedural rulings (service, personal jurisdiction, interim arbitration stays) that do not automatically cancel balances or set a “typical” settlement percentage
Treat headlines and docket snippets as case-specific. An order in one merchant’s file does not set your settlement percentage, defense, or deadline.
Case spotlight: Forward Fin. LLC v. Moss Supermarket LLC (2018)
On March 29, 2018, the U.S. District Court for the District of Massachusetts decided Forward Fin. LLC v. Moss Supermarket LLC, 303 F. Supp. 3d 209 (Wolf, J.) (C.A. No. 16-11804-MLW).
According to the published opinion:
- Forward alleged it paid $135,000 to Moss Supermarket, LLC in exchange for ten percent of daily receipts until a total of $194,400 was collected, and that payments stopped about two weeks later; the principal was alleged not to have indemnified as agreed
- A clerk’s default had been entered; Forward moved for default judgment
- The court found no allegations or evidence establishing personal jurisdiction over the California defendants under the Due Process Clause and the Massachusetts long-arm statute, and that service on Moss did not comply with Fed. R. Civ. P. 4
- The motion for default judgment was denied without prejudice; Forward was ordered to serve properly and, for any renewed motion, to submit a memorandum and evidence on personal jurisdiction
Public docket indexes later show a notice of voluntary dismissal and case closure in that matter. Those later entries are procedural, not a published merits ruling that every Forward agreement is void.
What this decision does not establish
- It does not hold that the underlying future-receipts agreement was usurious or unenforceable on the merits
- It does not award damages, cancel balances, or set a “typical” Forward Financing settlement rate
- It does not pause deadlines in a different Forward suit against another merchant
- It does not replace reading your summons, contract, guarantees, payment history, and any later settlement or arbitration papers
Our Forward Financing company profile covers company-described reconciliation concepts without inventing litigation outcomes.
Merchant-side usury allegation: Streamlined Consultants (SDNY)
In 2021, Streamlined Consultants, Inc. and Moshe Schoenwald v. Forward Financing LLC et al., S.D.N.Y. No. 7:21-cv-10838 (Roman, J.), plaintiffs sued in New York state court alleging that a Future Receipts Sale Agreement was an usurious loan (public summaries describe an $81,000 purchase price for $118,260 in future receipts with remittance tied to a percentage of monthly receivables). Forward removed the case to federal court and initiated parallel AAA arbitration.
On March 14, 2022, the court denied plaintiffs’ emergency request for an immediate temporary interim stay of that parallel arbitration, finding they had not shown the arbitration agreement was invalid or that the dispute could not be arbitrated, and had not met preliminary-injunction standards. That order addressed the interim stay request. It did not decide the underlying usury or unconscionability claims on the merits.
Check PACER for current status before relying on any snapshot. A pleading that labels a product a “loan” is not the same as a published judgment voiding every Forward Financing agreement.
Arbitration confirmations in New York courts (illustrative)
Public indexes and arbitration-document repositories list multiple matters captioned along the lines of In the Matter of the Arbitration Between Forward Financing LLC and a merchant/guarantor, often seeking confirmation of an AAA award under CPLR §§ 7510 and 7514. Examples checked for context, not as a complete litigation census:
- Nassau County petition materials publicly indexed for Forward Financing LLC v. MDG1 Transport LLC et al. (Index No. 600480/2024, filed Jan. 9, 2024) describe a May 11, 2023 Future Receipts Sale Agreement (alleged $24,000 purchase price for $33,600 Amount Sold; weekly remittance figure recited in the petition) and seek confirmation of a December 22, 2023 arbitration award. A filed petition is not itself a final judgment unless and until the court enters one. Verify the live NYSCEF status
These examples illustrate a confirmation-of-award path. They do not prove how often Forward sues, what fraction of merchants settle, or what percentage you “should” pay.

How Forward describes its revenue-based financing, reconciliation and payment-adjustment terms belongs to the company profile linked near the top of this page. For a lawsuit, the signed agreement controls, not company marketing.
If Forward Financing is suing you (or confirming an award): practical checklist
- Calendar the real response deadline from the summons/petition and proof of service. Missing it can allow default or confirmation even while you research online
- Match the plaintiff name on the caption to your contract, ACH descriptors, and any assignment notices
- Gather the stack: original Future Receipts Sale Agreement, personal guaranty, amendments, reconciliation requests/responses, payment history, AAA papers if any, and every court filing
- Do not assume Yellowstone-style relief applies. Forward Financing is not the covered Yellowstone entity list described in OAG materials
- Coordinate settlement talk with counsel/docket and arbitration calendars. Negotiating does not automatically stop a court or AAA deadline

FAQ
Is there a “Forward Financing lawsuit” settlement I can join?
Not in the sense of the public Yellowstone FTC refund or NY AG debt-cancellation programs described on our Yellowstone Capital lawsuit page. Forward-related results in the sources above are largely private commercial / arbitration matters. Any settlement of your file would be case-specific.
Does the Moss Supermarket opinion mean Forward cannot win judgments?
No. The court denied one default-judgment path in that file for service and personal-jurisdiction showings. Other cases, other forums (including arbitration confirmation), and other facts can produce different results.
My agreement has an AAA clause: does that mean there will be no public court case?
Not necessarily. Many disputes stay private in arbitration, but awards can still be brought to state court for confirmation and judgment entry. Always read the papers you actually received.
Forward sued my company: should I ignore ACH pulls?
Do not change remittances based on a news headline alone. Changing payments can affect default clauses, settlement leverage, and bank relationships. Get jurisdiction-specific advice on your papers first.
Can a settlement company or attorney help while a suit or arbitration is pending?
Sometimes parties still negotiate after filing, but court and arbitration deadlines continue unless formally changed. Compare written scopes and fees. See attorneys vs settlement companies and our MCA settlement overview.

Takeaway
Treat “Forward Financing lawsuit” as a search for private commercial litigation and arbitration. Often followed by NY confirmation petitions, not an automatic industry refund. Read the caption, the deadline, and the actual order or award. The 2018 Moss Supermarket opinion shows why one default-judgment path failed on service and jurisdiction; it does not cancel other Forward balances or set a win rate.
