Searches for CFG Merchant Solutions lawsuit usually surface private commercial collection and contract disputes involving CFG Merchant Solutions, LLC, not a Federal Trade Commission or New York Attorney General industry-wide enforcement action like the public Yellowstone Capital lawsuit track. This page summarizes what a few identifiable New York public opinions establish, and what a single order does not prove about your file.

Why CFG lawsuit results look different from Yellowstone

Yellowstone Capital appears in agency enforcement materials (FTC settlement/refunds; later NY AG settlement with debt cancellation for covered Yellowstone entities). CFG results more often look like:

  1. Funder-as-plaintiff suits against a merchant and guarantor for alleged breach of a receivables-purchase agreement, a later settlement, or both
  2. Motions for summary judgment that sometimes succeed against a company, sometimes fail for proof / business-records problems, and sometimes treat guarantor liability separately
  3. Occasional non-merchant commercial disputes naming CFG (for example, joint-venture / underwriting fee fights), which are not the same as your ACH-remittance file

Treat headlines and docket snippets as case-specific. An order in one merchant’s file does not set your settlement percentage, defense, or deadline.

Case spotlight: Valentis: company vs guarantor (2022)

On September 16, 2022, New York County Supreme Court decided CFG Merchant Solutions, LLC v. Valentis Security Services, Inc. (published as 2022 NY Slip Op 50875(U) / 76 Misc 3d 1212(A)).

According to the published decision (as summarized on our CFG funder file and the slip opinion):

  • CFG sought summary judgment on claims tied to settlement documents after an earlier receivables relationship
  • The court granted summary judgment against the company on the settlement claim (money judgment figures appear in the opinion)
  • The court denied summary judgment against the individual guarantor on the showing then made, including limits on using a notice to admit to resolve ultimate liability issues
  • Guarantor claims were severed and continued; denial of that branch was not a final cancellation of all personal exposure

What this decision does not establish

  • It does not hold that every CFG receivables agreement or settlement is void
  • It does not set a “typical” CFG settlement rate or prove how often guarantors escape liability
  • It does not pause deadlines in a different CFG suit against another merchant
  • It does not replace reading your summons, contract, guarantees, later settlements, and payment history

Case spotlight: Home Media Tech: summary judgment denied (2024)

On October 15, 2024, Kings County Supreme Court (Rivera, J.) decided CFG Merchant Solutions, LLC v. Home Media Tech Fl Inc. et al., 2024 NY Slip Op 33653(U) (Index No. 516828/2023).

According to the published opinion:

  • CFG alleged a February 10, 2023 receivables-purchase agreement and personal guarantee, claiming it purchased a percentage of future receivables with an agreed value of $244,200, that the merchant later interfered with ACH collection, and that balances/fees remained due
  • CFG moved, unopposed, for summary judgment under CPLR 3212
  • The court still had to test whether CFG made a prima facie showing. It found material issues around CFG’s claimed performance (including how prior balances and funding were documented) and therefore denied summary judgment against both the company and the guarantor, without treating lack of opposition as an automatic win
  • The court also noted unjust enrichment could not proceed alongside a claim based on a valid contract covering the same subject matter

What this denial does not establish

  • It does not cancel the underlying agreement or guarantee
  • It does not prevent CFG from trying again with different proof, proceeding to trial, or settling
  • It does not mean every unopposed CFG motion will fail

Case spotlight: Complete Auto: business-records foundation (2024)

On November 8, 2024, Kings County Supreme Court (Maslow, J.) decided CFG Merchant Solutions, LLC v. Complete Automotive Repair Service, LLC et al., 2024 NY Slip Op 51512(U) (Index No. 510085/2024).

According to the published opinion:

  • CFG alleged it purchased $22,350 of future receivables for a $15,000 purchase price, with a personal guarantor, and sought summary judgment for unpaid receivables plus default fees
  • The court denied the motion because CFG failed to lay a proper CPLR 4518 business-records foundation for the payment history and related exhibits (including third-party / coded remittance data), so it never made a prima facie breach case

Again: a procedural denial is not a public declaration that MCA products are unlawful industry-wide, and it is not a win-rate statistic.

Other public dockets (illustrative, not exhaustive)

Public indexes list additional CFG captions, some granting money judgments on summary judgment, some denying or limiting relief, some addressing notice-to-admit practice or loan-versus-sale arguments. Examples checked for context only:

  • CFG Merchant Solutions, LLC v. Essential Foundations Preschool & Learning Center LLC, 2025 NY Slip Op 33547(U), Supreme Court, Kings County (Index No. 518812/2025), published order granting CFG summary judgment for a stated money amount plus interest
  • CFG Merchant Solutions, LLC v. Tawa Roti Dhaulagiri Food, Corp., 2024 NY Slip Op 34470(U), Supreme Court, New York County (Index No. 157288/2021), where the court denied both CFG's summary judgment motion and the defendants' cross-motion; the decision discusses notice-to-admit limits and MCA vs loan factor analysis on the papers in that file
  • Separate commercial dockets naming CFG outside classic merchant ACH collection (for example, joint-venture fee arbitration confirmation matters). Those are not substitutes for reading your receivables agreement

We did not run a full multi-jurisdiction search of every county clerk. Absence of a case from this page is not evidence it does not exist.

If CFG Merchant Solutions is suing you: practical checklist

  1. Calendar the real response deadline from the summons/complaint and proof of service. Missing it can allow default even while you research online
  2. Match the plaintiff name on the caption to your contract, ACH descriptors, and any assignment notices
  3. Gather the stack: original receivables-purchase agreement, personal guaranty, amendments, later settlements, remittance history, UCC search results, and every court paper
  4. Separate company vs guarantor analysis: Valentis is a reminder that those tracks can diverge
  5. Do not assume Yellowstone-style relief applies. CFG is not the covered Yellowstone entity list described in OAG materials
  6. Coordinate settlement talk with counsel/docket obligations. Negotiating does not automatically stop a court calendar

FAQ

Is there a “CFG Merchant Solutions lawsuit” settlement I can join?

Not in the sense of the public Yellowstone FTC refund or NY AG debt-cancellation programs described on our Yellowstone Capital lawsuit page. CFG-related results in the sources above are largely private commercial cases. Any settlement of your file would be case-specific.

Does a denied summary judgment mean I won?

Usually not finally. It means the court found CFG had not yet met its burden for judgment as a matter of law on that motion. Claims can continue, settle, or be re-briefed depending on the case.

CFG sued my company and me as guarantor: same outcome?

Not automatically. Courts sometimes grant relief against the merchant while denying or severing guarantor claims (see Valentis). Your signed guarantee and the evidence against you control.

CFG sued my company: should I ignore ACH pulls?

Do not change remittances based on a news headline alone. Changing payments can affect default clauses, settlement leverage, and bank relationships. Get jurisdiction-specific advice on your papers first.

Can a settlement company or attorney help while a suit is pending?

Sometimes parties still negotiate after filing, but court deadlines continue unless formally changed. Compare written scopes and fees. See attorneys vs settlement companies and our MCA settlement overview.

Where else should I read on this site?

Start with the merchant cash advance lawsuit hub, and MCA debt relief options. For company comparisons, see reviews.

Takeaway

Treat “CFG Merchant Solutions lawsuit” as a search for private commercial litigation. Often receivables-purchase / settlement enforcement in New York courts, not an automatic industry refund. Read the caption, the deadline, and the actual order. Valentis, Home Media Tech, and Complete Auto show why company vs guarantor proof and business-records foundations matter; they do not cancel other CFG balances or set a win rate.
