Searches for Itria Ventures lawsuit usually surface private commercial disputes over Future Receivables Sale Agreements (FRSAs) involving Itria Ventures LLC, plus a separate FTC enforcement matter that also names affiliate Biz2Credit, Inc., not a New York Attorney General industry-wide MCA debt-cancellation program like the public Yellowstone Capital lawsuit track. This page summarizes what identifiable public opinions and agency materials establish, and what a single order does not prove about your file.

Quick answer

QuestionWhat the public record supports on this page
Who appears in captions?Filings commonly name Itria Ventures LLC; some agency materials also name Biz2Credit, Inc. (described in FTC materials as related)
Is there an FTC / NY AG “Itria MCA refund” program?FTC materials describe a 2024 stipulated monetary judgment against Biz2Credit and Itria tied to PPP processing-time advertising, not a general MCA balance-cancellation program. No NY AG Itria debt-cancellation program is described in the sources checked for this page
Pattern in many NY opinionsItria as plaintiff (or arbitration claimant) on receivables-sale / FRSA contracts and personal guarantees; merchants raising usury / “true loan” theories, discovery fights, or arbitration stays
Recent summary-judgment exampleItria Ventures LLC v. Aneela 1 LLC (2025 NY Slip Op 32925(U), July 16, 2025): New York County Supreme Court denied Itria’s summary-judgment motion in its entirety as premature / insufficient on that record
Arbitration exampleVaidya v. Itria Ventures LLC (2024 NY Slip Op 32709(U), Aug. 2, 2024): court denied guarantors’ petition to stay arbitration and compelled arbitration under the FRSAs (FAA)
Does an SJ denial wipe Itria balances? No. Denying summary judgment means the movant failed a procedural burden that day, not that every Itria FRSA is invalid

Why Itria lawsuit results look different from Yellowstone

Yellowstone Capital appears in agency enforcement materials with consumer/merchant redress narratives (FTC refunds; later NY AG settlement with debt cancellation for covered Yellowstone entities). Itria’s public footprint more often looks like:

  1. Funder-as-plaintiff FRSA / receivables-purchase suits against merchants and guarantors in New York Supreme Court
  2. Arbitration notices and CPLR 7503 stay/compel fights over broad FRSA arbitration clauses (sometimes with confessions of judgment on other agreements)
  3. A separate FTC stipulated order focused on PPP application timing claims involving Biz2Credit and Itria, not a holding that every Itria MCA is void
  4. Occasional proposed class actions that were voluntarily dismissed without a class judgment

Treat headlines and docket snippets as case-specific. An order in one merchant’s file does not set your settlement percentage, defense, or deadline.

Case spotlight: Aneela: summary judgment denied (2025)

On July 16, 2025, New York County Supreme Court (Morales-Minerva, J.) decided Itria Ventures LLC v. Aneela 1 LLC et al. (2025 NY Slip Op 32925(U)), Index No. 653252/2023.

According to the published decision:

  • Itria described its business as purchasing future receivables to provide working capital
  • On January 19, 2023, Itria and Aneela 1 LLC d/b/a Sams Food Store and Aneela 2 LLC entered a Receivables Sale Agreement under which Itria agreed to pay $125,000 (less fees) for $156,250 of future receivables, remitted in weekly installments of $3,255.21, with a performance guaranty by Muhammad Rashad Munir; a later April 2023 RSA with related Aneela entities also appears in the complaint exhibits
  • Itria moved for summary judgment on breach-of-contract / unjust-enrichment theories and to strike affirmative defenses
  • The court denied the summary-judgment motion entirely, treating it as premature where discovery was still in its infancy, depositions remained outstanding, and no preliminary conference / discovery schedule had been completed despite an earlier order
  • The court also found Itria’s supporting counsel affirmation insufficient to the extent it relied on corporate records and discussions with employees rather than adequate firsthand foundational proof for summary judgment
  • Separately, the court dismissed some (but not all) affirmative defenses (including an adhesion defense pleaded as a bare conclusion), while leaving others intact, including failure to state a cause of action

What Aneela does not establish

  • It does not hold that every Itria FRSA is usurious or void
  • It does not set a typical Itria settlement rate or merchant win rate
  • It does not pause deadlines in a different Itria suit or arbitration
  • Denial of SJ keeps the case alive for further proof; it is not a final cancellation of the claimed balance

Case spotlight: Vaidya: arbitration compelled (2024)

On August 2, 2024, New York County Supreme Court (Cohen, J.) decided Vaidya v. Itria Ventures LLC (2024 NY Slip Op 32709(U)), Index No. 651169/2024.

According to the published decision:

  • From March 31, 2022, to January 27, 2023, Itria provided about $4.3 million in funding to merchant entities owned/controlled by the petitioners under eight FRSAs, with personal guarantees
  • After alleged defaults, Itria obtained judgments via confessions of judgment on four agreements and served notices of intent to arbitrate on the remaining merchant claims and on all eight guarantees
  • Guarantors petitioned under CPLR 7503 to permanently stay arbitration; Itria cross-moved to compel
  • The court found broad FRSA arbitration clauses, applied the Federal Arbitration Act, and held that a challenge to the contract as a whole (including a usury / disguised-loan theory) goes to the arbitrator in the first instance under Buckeye Check Cashing when the challenge is not aimed specifically at the arbitration clause
  • Petition to stay denied; motion to compel arbitration granted

What Vaidya does not establish

  • Compelling arbitration is not a ruling that the underlying FRSA is enforceable on the merits, or that it is usurious
  • It does not create a public refund program
  • Confession-of-judgment practice on other agreements in the same relationship remains fact-specific

Agency note: FTC v. Biz2Credit / Itria (PPP timing: 2024)

Public FTC case materials for FTC v. Biz2Credit, Inc. and Itria Ventures LLC, S.D.N.Y. No. 24-cv-2001, describe a March 2024 complaint and stipulated order for permanent injunction and monetary judgment. Agency summaries state the companies agreed to pay $33 million in damages to settle charges that they deceptively advertised average PPP application processing times (claimed on the order of 10-14 business days) when average processing allegedly took much longer.

What this FTC matter does not establish

  • It is not an industry-wide finding that every Itria FRSA / MCA is a usurious loan
  • It does not, by itself, cancel private receivables balances or create an automatic MCA settlement discount
  • Do not confuse PPP advertising claims with the separate FRSA collection / arbitration dockets above

Related note: dismissed proposed class action (2022)

A proposed class action, InvenTel.TV LLC et al. v. Itria Ventures LLC et al., No. 1:22-cv-01059 (D.N.J.), alleged fraudulent misrepresentation of loans as future-receivables purchases and related RICO / usury theories. Public reporting states the plaintiff voluntarily dismissed the suit without prejudice on March 2, 2022. A voluntary dismissal without prejudice is not a class judgment, a refund order, or a finding on the merits.

What to do if Itria / Biz2Credit is in your caption or arbitration notice

  1. Calendar every deadline on the summons, motion, or arbitration notice. Arbitration clocks and court clocks both move
  2. Match entities: Itria Ventures LLC vs. Biz2Credit, Inc., plus any merchant entities and guarantors named in FRSAs / COJs
  3. Preserve all FRSAs and amendments, guarantees, ACH / remittance history, confession-of-judgment papers, arbitration notices, and fee ledgers
  4. Read MCA lawsuit first 30 days and what is MCA settlement before assuming any industry-average discount
  5. Get jurisdiction-specific advice on your papers; this page is desk research, not representation

FAQ

Is there an Itria Ventures FTC refund for MCA balances?

Public FTC materials tied to Biz2Credit / Itria describe a PPP processing-time settlement with a large stipulated monetary judgment. That is not the same as a general MCA debt-cancellation or Yellowstone-style refund portal for every FRSA balance. Monitor official FTC case pages for any claims process rather than assuming automatic merchant refunds.

Does “Itria Ventures lawsuit” mean my FRSA is automatically void?

No. Aneela shows summary judgment can be denied as premature without voiding the contract. Vaidya shows usury challenges to the agreement as a whole may be sent to arbitration under the FAA. Outcomes are case-specific.

Why do some Itria disputes go to arbitration instead of court?

Many FRSAs contain broad arbitration clauses. Courts may compel arbitration when the Federal Arbitration Act applies and the challenge is not aimed specifically at the arbitration clause itself (Vaidya). Some agreements also allow judicial collection after a defined “Material Breach,” which can produce parallel court and arbitration tracks. Read your papers carefully.

Can a settlement company or attorney help while a suit or arbitration is pending?

Sometimes parties still negotiate after filing, but deadlines continue unless formally changed. Compare written scopes and fees. See attorneys vs settlement companies and our MCA settlement overview.

Takeaway

Treat “Itria Ventures lawsuit” as a search that may mix private FRSA / arbitration enforcement with a separate FTC PPP advertising settlement, not an automatic industry MCA refund. Read the caption, the deadline, and the actual order. Aneela and Vaidya show why discovery timing and arbitration clauses matter; they do not cancel other Itria balances or set a win rate.
